Senator JD Vance from Ohio has put forward a legislative proposal named The Passport Sanity Act. This bill aims to stop the Secretary of State from issuing passports, passport cards, or Consular Reports of Birth Abroad that include an "X" gender designation. The legislation mandates that applications for these documents should only have male and female gender options.

Senator Vance stated, "The last thing the State Department should be doing is wasting its time and your tax dollars pushing far-left gender ideology." He emphasized his belief in the existence of only two genders and expressed pride in introducing this bill to bring what he described as "sanity" back to federal operations.

This Senate bill complements a similar measure introduced in the House by Congressman Chip Roy from Texas. Congressman Roy remarked, "There are two sexes — male and female — and government documents like passports should reflect that self-evident truth." He criticized what he sees as radical gender ideology influencing government practices and expressed support for this joint effort with Senator Vance.

In 2022, the State Department allowed U.S. passport applicants to choose an "X" gender marker on their forms alongside traditional male ("M") or female ("F") designations. This made it the first federal agency to offer such an option on identity documents.
