Washington, D.C. - Senators JD Vance (R-OH) and Marco Rubio (R-FL) are set to introduce the Fairness for Stay-At-Home Parents Act, a legislation aimed at protecting stay-at-home parents from being burdened with excessive healthcare costs. The proposed act would amend the Family and Medical Leave Act (FMLA) to include "birth of a child" as a protected reason for not returning to work.
The bill seeks to prevent employers from reclaiming healthcare premiums and ensure that employers subject to the FMLA continue their health premium contributions during the 12-week leave period. This legislation comes as a response to the current law that allows employers to clawback health care premiums paid on behalf of employees who do not return to work after family leave, penalizing mothers who choose to prioritize their child's early development and recovery.
"Our laws should not penalize new parents who choose to stay home to care for their newborn babies," stated Senator Vance. "We should celebrate and promote young families, not punish them. This legislation would relieve a serious financial burden for working families all over America and steer Washington in a more pro-family direction."
Senator Rubio also expressed his support for the Fairness for Stay-At-Home Parents Act, highlighting the importance of recognizing the invaluable role of mothers and parents in raising the next generation. He emphasized that the legislation would prevent employers from imposing harsh financial penalties on parents who decide not to return to work after unpaid leave, allowing families to make choices that prioritize the well-being of their children.

The Fairness for Stay-At-Home Parents Act addresses a clear gap in the FMLA and aims to provide much-needed support to stay-at-home parents.
